The ILLEGAL Immigration Solution

All of these votes.

All of these amendments.

So much hostility.

So many unnecessary headaches.

There is a simple solution to get a grip on the ILLEGAL immigration problem. It's not a perfect solution, but at least it's a start. It would be much better than the immigration bill currently being considered in Senate.

This solution should appeal to the libs, always looking to forfeit our sovereignty, give a back seat to American interests, and kowtow to the global community.

It should also make the conservatives happy. It takes a tough stance on upholding the rule of law.

Let's have a uniform policy for all countries of the Americas.

The United States and Mexico could be the first to adopt the shared policy.

Actually, Mexico wouldn't have to do anything. The country already employs this policy.

All we have to do is follow Mexico's lead. We can model U.S. immigration law on current Mexican immigration law.

Mexico has a radical idea for a rational immigration policy that most Americans would love. However, Mexican officials haven’t been sharing that idea with us as they press for our Congress to adopt the McCain-Kennedy immigration reform bill.

That's too bad, because Mexico, which annually deports more illegal aliens than the United States does, has much to teach us about how it handles the immigration issue. Under Mexican law, it is a felony to be an illegal alien in Mexico.

At a time when the Supreme Court and many politicians seek to bring American law in line with foreign legal norms, it’s noteworthy that nobody has argued that the U.S. look at how Mexico deals with immigration and what it might teach us about how best to solve our illegal immigration problem. Mexico has a single, streamlined law that ensures that foreign visitors and immigrants are:
---in the country legally;

---have the means to sustain themselves economically;

---not destined to be burdens on society;

---of economic and social benefit to society;

---of good character and have no criminal records; and

---contributors to the general well-being of the nation.

The law also ensures that:
---immigration authorities have a record of each foreign visitor;

---foreign visitors do not violate their visa status;

---foreign visitors are banned from interfering in the country’s internal politics;

---foreign visitors who enter under false pretenses are imprisoned or deported;

---foreign visitors violating the terms of their entry are imprisoned or deported;

---those who aid in illegal immigration will be sent to prison.

Who could disagree with such a law? It makes perfect sense. The Mexican constitution strictly defines the rights of citizens -- and the denial of many fundamental rights to non-citizens, illegal and illegal. Under the constitution, the Ley General de Poblaciƃ³n, or General Law on Population, spells out specifically the country's immigration policy.

It is an interesting law -- and one that should cause us all to ask, Why is our great southern neighbor pushing us to water down our own immigration laws and policies, when its own immigration restrictions are the toughest on the continent?

If a felony is a crime punishable by more than one year in prison, then Mexican law makes it a felony to be an illegal alien in Mexico.

Why struggle to construct a massive, comprehensive overhaul of our immigration policy?

Why not just adopt the policy that works so well for our good neighbors to the south?

Introduction
First, I would like to point out that I am not in favor of illegal immigration but I am very much in favor of legal immigration. These are just my thoughts and and are without a whole lot of knowledge of the current law.

Allow quotas by country
• Number of Immigrant Visas Granted by Country. These quotas should remain high but balanced to support the employment needs of the US employers.

Definition of Legal Immigrant
• An immigrant in the US that has been in the US for 3 months or less, or
• An immigrant who is employed or has been employed in the US within the last 6 six months and is the authorized holder of a US immigrant visa.

Definition of Types of Visas and their respective Skill Shortage Levels
• Immigrant or sponsor must pay application fee. Upgrades can be applied for with payment of additional fee and the immigrant remained in compliance with terms and conditions set forth in this document.
Duration: 1 year
Skill Level: Low
Description: no high school equivalent diploma, not required to pass the English oral and written test, and will be hired in low-skill labor such as, landscaping, farming, construction, etc.
Application Fee: $250

Duration: 2 years
Skill Level: Medium
Description: Has high school diploma or above, must pass English oral and written test, and will be hired in administrative and semi-professional jobs.
Application Fee: $350

Duration: 5 years
Skill Level: High
Description: Recognized college degree, must pass English oral and written test, at least 5 years of professional work experience, and will be hired in professional jobs
Application Fee: $550

Duration: 7 years
Skill Level: Extremely High
Description: Recognized US skill shortage, doctors, nurses, etc. and must pass English oral and written test.
Application Fee: $850

Employer Responsibility Towards Immigrants

• All immigrant visas are renewable and upgraded by employer (or immigrant) sponsor 90 days prior to expiration. Visa renewal guaranteed if employer and immigrant have remained in compliance with criteria in this document.
• Illegal immigrants may work in the US but the employer will pay an additional 20% in taxes to US Government and an additional 5% to the state employed on top of current tax rate.
• Employers who fail to accurately report immigrant hiring and their status will be fined a minimum amount equal to 2 times the immigrant’s annualized income plus pay taxes (25% federal, 5% state) and late fees on fined amount (1% per month) for the entire period of suspected work in US.
• Immigrants, legal and illegal, must be paid at least federal and/or state minimum wage and in accordance with typical wages for skills and location of same US worker.
• Verification of legal visa will be confirmed online by employer (name, picture, and fingerprint).

Immigrant Responsibility To Eork in US

• Eligible for apply for citizenship after 7 years of concurrent stay or 10 years non-concurrent with no felonies and full compliance with criteria in this chart. This eligibility also applies to non-US citizen spouse and children of immigrant.
• Must complete and pass criminal background check for initial visa and every subsequent renewal.
• Must be employed legally at time of renewal request.
• Must pass oral and written English test within 1 year of receiving visa if applying for visa beyond a 1-year stay.
• Must remain employed (unemployed 6 months or longer will terminate visa and they must return to home country). Failure to notify immigration officials of employment status and return visa after 6 months of unemployment will make immigrant ineligible for future visa renewal. Assuming compliance the new employer will reactivate visa when registered for employment. If visa is expired then a new visa application is required.
• Must have 'permanent' address within 3 months of arriving in US.
• Must have an employer sponsor. This can be obtained after arrival (but within 6 months of arrival date).
• Immigrant must notify immigration officials to change in employment status within 30 days of change.
• Once approved the immigrant will receive highly secure visa card with expiration date.
• Those immigrants (legal and illegal) currently in the US must obtain employer sponsorship and obtain necessary clearances and documents stated above.
• No government paid remedial English classes. If needed employer or immigrant will pay for remedial English classes for spouse and children of immigrant.
• Spouses may apply for visas to work and must meet the same criteria of immigrant.

Other Services

• Transfer agents such as Western Union will be required to collect and pay a 25% surcharge to the US Government prior to any funds leaving the US. 10% of this surcharge will be refunded upon return of the immigrant visa and verification of immigrant’s return to home country. Immigrant cannot reapply for an immigrant visa without repaying the 10% surcharge received and applicable application fees to the US Government.
• Illegal (unregistered) immigrants will not be entitled social security funds and associated benefits and therefore will not have deductions taken from pay.
• Legal immigrants will be entitled to all government benefits as state and federal law allow.
• Spouse and children of immigrant must pass both the oral and written English test prior to school enrollment. Testing will be paid by employer or immigrant.
