Mark Levin: 'Most Remarkable Power Grab in American History'

J.B. Van Hollen, Wisconsin's attorney general, announced on Thursday that he wanted approval from Democrats to sue the federal government over ObamaCare.

Of course, Gov. Jim Doyle and Wisconsin Dems will block that effort.

But several other attorneys general are going to challenge the constitutionality of the ObamaCare mandate that an individual buy health insurance.

Talking with Neil Cavuto this morning, Mark Levin, a constitutional lawyer and radio host, discusses the Democrats' outrageous power grab.

NEIL CAVUTO: What do you make now... first, your petition was against the so-called Slaughter amendment. This was the so-called Deem vote. They obviously shelved that in favor of just a straight up or down vote. But now what? What's your foundation up to now? What are you looking at now?

MARK LEVIN: Well, these attorneys general are on the right path, some of them. And what we're looking at is supporting their efforts. And we're going to continue to do that.

Let me be very clear about what's going on here: What they're mandating here for individuals is that the government is saying you are compelled to purchase a private health insurance contract from another private entity. That has never occurred in American history.

I am familiar with the Supreme Court precedent with respect to the Commerce Clause. Even that court, even the FDR court, wouldn't go that far because that's a step too far and that means there would be absolutely no limits on the federal government controlling your private behavior -- what you can buy and you can't buy.

This is not commerce. This in inactivity. This is non-commerce if somebody chooses not to purchase something. It's not a tax because they're not taxing you. It's not a single payer plan. They are compelling you to do something with your money, which is not a tax.

It is the most remarkable power grab in American history against the individual.

Remarkable indeed! Gone are the days when our government leaders are acting as representatives of the people to support and protect the citizenry. Right now, we are compelled to follow a law which allow the government to have a subtle intrusion in our individual lives.
