Whittemore's Opinion
In his opinion, Judge James D. Whittenmore stated that the Schindlers have shown irreparable harm will occur if a temporary restraining order protecting Terri Schiavo is not issued. However, he writes that the Plaintiffs must establish a substantial likelihood of success on the merits of their claims. "On careful consideration of each count, the Court concludes that Plaintiffs have not shown a substantial case on the merits," Whittenmore writes.
