Thanks to the relentless investigative work of Senate Finance Committee Chairman Chuck Grassley (R-Iowa) and Senate Homeland Security and Governmental Affairs Committee Chairman Ron Johnson (R-Wis.), we are learning that the Hillary Clinton email case may not really be settled.

A staff memo updating the two senators’ long-running probe discloses that the FBI — the version run in 2016 by the now-disgraced and fired James Comey, Andrew McCabe and Peter Strzok — failed to pursue access to “highly classified” evidence that could have resolved important questions.

The failure to look at the evidence back in 2016 occurred even though the agents believed access to the sensitive evidence was “necessary” to complete the investigation into Clinton’s improper transmission of classified emails — some top secret — on her unsecure private email server, the memos show.

To make matters worse, the Trump Department of Justice (DOJ) has known about that decision since at least 2018, thanks to the work of the DOJ’s internal watchdog, Inspector General (IG) Michael Horowitz, who provided DOJ leaders and Congress with a classified appendix explaining what happened.

But Johnson and Grassley have been unable to get answers for a year, even from Attorney General William Barr, about whether the FBI intends to look at the critical evidence it skipped back in 2016.

The Senate staff memo succinctly lays out just how egregious the FBI’s decision was in 2016.

The inspector general’s “appendix raised a number of serious questions because, as explained on page 154 of the unclassified DOJ IG report, the FBI decided not to seek access to certain highly classified information potentially relevant to the investigation despite members of the FBI case team referring to the review as a ‘necessary’ part of the investigation,” the Senate staff wrote.

“As a result of the findings in that appendix, Senator Grassley wrote a classified letter to DOJ on October 17, 2018, which remains unanswered. On January 15, 2019, at Mr. Barr’s nomination hearing, Senator Grassley asked Mr. Barr if he would answer the letter, if confirmed, to which he attested, ‘Yes, Senator.’ On April 16, 2019, Senators Grassley, Johnson, and Graham sent a letter to Attorney General Barr reiterating the need for a written response to that letter."

This is a scandal.

The corruption in the FBI must be investigated.

A Chinese-owned company operating in the Washington, D.C., area hacked Hillary Clinton’s private server throughout her term as secretary of state and obtained nearly all her emails, two sources briefed on the matter told The Daily Caller News Foundation.

The Chinese firm obtained Clinton’s emails in real time as she sent and received communications and documents through her personal server, according to the sources, who said the hacking was conducted as part of an intelligence operation.

The Chinese wrote code that was embedded in the server, which was kept in Clinton’s residence in upstate New York. The code generated an instant “courtesy copy” for nearly all of her emails and forwarded them to the Chinese company, according to the sources.

The Intelligence Community Inspector General (ICIG) found that virtually all of Clinton’s emails were sent to a “foreign entity,” Rep. Louie Gohmert, a Texas Republican, said at a July 12 House Committee on the Judiciary hearing. He did not reveal the entity’s identity, but said it was unrelated to Russia.

This is kind of a big deal.

Abedin was supposed to appear in court Wednesday for divorce proceedings, but her attorney instead submitted paperwork signed by both sides that agreed to end the case, the New York Post reported.

The judge declared the case “discontinued,” the Post said.

Comey Clinton Statement Edits

Newly released documents obtained by Fox News reveal that then-FBI Director James Comey’s draft statement on the Hillary Clinton email probe was edited numerous times before his public announcement, in ways that seemed to water down the bureau’s findings considerably.

Sen. Ron Johnson, R-Wis., chairman of the Senate Homeland Security Committee, sent a letter to the FBI on Thursday that shows the multiple edits to Comey’s highly scrutinized statement.

In an early draft, Comey said it was “reasonably likely” that “hostile actors” gained access to then-Secretary of State Hillary Clinton’s private email account. That was changed later to say the scenario was merely “possible.”

Another edit showed language was changed to describe the actions of Clinton and her colleagues as “extremely careless” as opposed to “grossly negligent.” This is a key legal distinction.

Johnson, writing about his concerns in a letter Thursday to FBI Director Christopher Wray, said the original “could be read as a finding of criminality in Secretary Clinton’s handling of classified material.”

He added, “The edited statement deleted the reference to gross negligence – a legal threshold for mishandling classified material – and instead replaced it with an exculpatory sentence.”

The edits also showed that references to specific potential violations of statutes on “gross negligence” regarding classified information and “misdemeanor handling” were removed.

The final statement also removed a reference to the “sheer volume” of classified information discussed on email.

...The Senate Homeland Security Committee is doing oversight of the Justice Department's Office of Special Counsel's investigation into whether Comey violated the Hatch Act with his statement. The Hatch Act limits the political activities of federal employees.

The edits in Comey's statement significantly alter its meaning.

That's very significant.

James Comey has a lot of explaining to do. It appears that he and his colleagues set out to protect Hillary Clinton.

The FBI released documents Monday proving former FBI Director James Comey began drafting a letter regarding Hillary Clinton's email investigation months before conducting several key interviews, including speaking to Clinton herself.

...The existence of the documents, reported by Newsweek, were first brought to light by Sen. Chuck Grassley, R-Iowa, chairman of the Senate Judiciary Committee, and Sen. Lindsey Graham, R-S.C., also a member of the committee, after they reviewed transcripts of interviews with top Comey aides who alluded to the email’s existence. The Senate Judiciary Committee is investigating Comey in his role as FBI director and President Trump’s decision to fire him in May.

The senators penned a letter on Aug. 30 to newly-appointed FBI Director Christopher Wray noting their findings, saying that “it appears that in April or early May of 2016, Mr. Comey had already decided he would issue a statement exonerating Secretary Clinton. That was long before FBI agents finished their work,” the letter said. “The outcome of an investigation should not be prejudged while FBI agents are still hard at work trying to gather the facts.”
